ppeal against appointment of Chief Election Commissioner Sikandar Sultan Raja rejected
ISLAMABAD: The Supreme Court has rejected an appeal against the appointment of Chief Election Commissioner Alexander Sultan Raja.
A two-member apex court bench headed by Justice Umar Ata Bandial heard the appeal against the appointment of Chief Election Commissioner Sikandar Sultan Raja.
During the hearing, Justice Umar Ata Bandial remarked that the Chief Election Commissioner and the Chairman NAB are not judicial officers. We appreciate your efforts in raising the constitutional point. You have also challenged the constitutional amendment in the petition. The Chief Election Commissioner is a retired civil servant. A retired bureaucrat cannot be appointed as the Chief Election Commissioner but according to the Constitution no constitutional amendment can be challenged.
During the interrogation of the petitioner’s counsel, Justice Umar Ata Bandial remarked that he said that the Chief Justice should be consulted for the appointment of the Chief Election Commissioner. The Chief Election Commissioner and the Chairman NAB are not judicial officers. Service Judge is not working as a member. Who are the service judges present in the Election Commission? There is no present service judge then the matter is over.
The apex court, while upholding the objections of the registrar’s office, rejected the petition. The court in its judgment said that the appointment of members, including the election commissioner, was on merit and not on the grounds against the appointment of the chief election commissioner.
